SCOPE OF WORK: The contractor agrees to perform the services described in the approved project quote or proposal. Any changes or additions must be approved in writing and may affect the cost and timeline.
Quotation and Pricing: All quotations are valid for 14 days from the date of issue unless otherwise stated. Prices may vary due to unforeseen circumstances or client-requested changes.
Payments and Deposits: A 70% deposit is required before work begins. Progress payments will be invoiced as outlined in the project agreement. Final payment is due upon completion and handover.
Project Timeline: Estimated start and completion dates will be provided. Delays due to weather, supplier issues, or changes to the scope may affect these dates. The contractor is not liable for delays beyond their control.
Client Responsibilities: The client must provide access to the site as needed, ensure utilities (water, electricity) are available, and remove personal property or obstructions that may hinder the work.
Changes and Variations: All changes to the original scope must be requested in writing and agreed upon. Additional charges and time extensions may apply.
Workmanship and Warranty: We offer a workmanship warranty of 12 months from the date of completion. This excludes normal wear and tear, damage caused by others, and materials supplied by the client.
Materials and Subcontractors: We reserve the right to substitute materials of equal quality and to engage subcontractors where necessary.
Liability: The contractor is covered by public liability insurance. However, we are not liable for delays caused by external parties, damages resulting from incorrect information provided by the client, or indirect or consequential losses.
Termination: Either party may terminate the agreement with written notice. The client is responsible for paying for work completed and materials ordered up to the date of termination.
Dispute Resolution: In the event of a dispute, both parties agree to attempt resolution through mediation before taking legal action.
Governing Law: This agreement is governed by the laws of South Africa.
Acceptance: By approving the quote or paying the deposit, the client agrees to these terms and conditions.
